General Terms and Conditions of Sale
1. Scope of Application
These general terms and conditions of sale (GTC) apply to all orders and contracts concluded via the website localflorist.ch by LesFleurs Daily-flowers Sàrl (hereinafter referred to as 'localflorist.ch') between a customer and LesFleurs Daily-flowers Sàrl.
The GTC are an integral part of the contract between LesFleurs Daily-flowers Sàrl ('localflorist.ch') and the customer placing an order (the 'customer'). By placing an order, the customer confirms that they have read, understood, and unconditionally accepted the GTC.
LesFleurs Daily-flowers Sàrl reserves the right to change the GTC at any time. The version of the GTC published on the localflorist.ch website at the time of the order is applicable. In case of discrepancies between the GTC and any specific conditions mentioned in the order confirmation, the latter shall prevail. The version of the GTC cannot be unilaterally changed for the relevant order.
2. Account
To place an order, the customer must create an account on the localflorist.ch website (hereinafter referred to as the 'account'). The customer is fully responsible for the accuracy and completeness of the information provided and must update their account in case of changes, particularly their phone number, email address, and delivery address.
The customer must be at least 18 years old to create an account and order from localflorist.ch. Any communication sent to the customer via email to the address provided in their account is considered duly received by the customer.
The customer is responsible for the use of their account and the security of their password. It is the customer's responsibility to manage their account profile. The customer is responsible for any order placed through their account, even without their knowledge. If the customer suspects that a third party has accessed their account without authorization, they must immediately change their password and inform localflorist.ch.
Customers' personal data are processed in accordance with the applicable data protection policy.
Localflorist.ch reserves the right to delete customer accounts in case of suspected fraud. A refund of the virtual account balance is not provided. Localflorist.ch disclaims any liability in this regard.
3. Placing an Order
For every order placed, you will receive an order confirmation email within a few minutes. This confirmation includes your order number as well as detailed information about the purchased item(s), the purchase price, the delivery date, and the sender and recipient's address. It would be helpful if you could provide the order number each time you contact us regarding your order.
If you do not receive a confirmation of your order, please contact our customer service directly.
If we cannot accept your order, we will inform you and will not charge you for the product. If payment has already been made, it will be refunded. This could be due to the product being out of stock with the local florist, unexpected constraints on the local florist's resources that they could not reasonably prepare for, a pricing or product description error, or the local florist being unable to meet your specified delivery timeframe.
All orders are subject to review. Additional information may be requested, and in such cases, the order may be suspended.

4. Changes and Cancellation of Orders
Any flower order can be canceled up to two business days before the desired delivery date. It is essential to provide the number of the order in question.
After this period, cancellation or modification of the order can only be accepted subject to feasibility. In such cases, we do not guarantee a refund of the order value.
Any cancellation of the order must be communicated to us via the form on the contact page during regular office hours.

5. Prices
The price is the one calculated by the partner florist on the day of delivery and may vary depending on the season and region. The prices include value-added tax (VAT).
6. Payment
At the time of concluding the contract, the customer is obliged to pay the order amount to localflorist.ch.
Accepted payment methods are: Mastercard, Visa, PostFinance, American Express, TWINT, Invoice, localflorist.ch gift voucher.
For credit card payments, the applied exchange rate is the official daily rate of your credit card company.
Only the price indicated on localflorist.ch at the time of the order is binding.
7. Delivery
Each delivery is made to the address provided by the customer and according to the specified instructions. If the delivery details are incomplete (incomplete information, inaccessible address, etc.) or if no one is present to receive the order, localflorist.ch may be released from its delivery obligation by depositing the order at the nearest location to the specified delivery address, unless the customer promptly provides the necessary additions.
To ensure your order is processed by the florist as quickly as possible, the following information may also be helpful:
- For deliveries to hospitals, it is recommended to provide the department and room number. We guarantee delivery to the hospital reception.
- For deliveries to hotels, we recommend providing the room number and the name under which the recipient is registered at the reception (couple, group, etc.). We guarantee delivery to the hotel reception.
- For deliveries to companies, our florists may not be authorized to enter the offices. We guarantee delivery to the company reception.
Additionally, please note the following:
- Delivery time is only guaranteed for weddings and funerals.
- During their visit, our partner florist will attempt to deliver the flowers and leave a notification if the recipient is absent, and then attempt to contact them by phone later. If the florist is unable to deliver the flowers and cannot reach the recipient within 24 hours, we will be immediately informed of the non-delivery. You will then be informed either by phone or email.
- If the recipient is absent, the florist is authorized to deliver the bouquet to a third party (e.g., a neighbor, the reception, a concierge, the funeral home, etc.), provided that they are likely to pass it on to the recipient. The same applies to any enclosures (greeting card, gift, etc.) given to the florist.
- If the recipient refuses the delivered flowers without a specific reason, the order is considered fulfilled and delivered, and does not entitle a refund.
If the customer has chosen the 'pick-up from florist' option, the order is considered delivered when the customer picks it up from the defined florist with the order number.
We are not responsible for the incorrect entry of an email address by the customer. Duplicate orders or incorrect deliveries may be charged.
8. Flowers and Other Products
The flowers and other products may differ slightly from their photos. The images of the flowers and other products on our website are for illustrative purposes only. The images are provided by local florists and we use them in good faith. You understand that each flower is unique and we therefore cannot guarantee that the flowers delivered by the local florist will look exactly as shown in the website images and may differ slightly from them. The local florist may also be forced to make minor adjustments to the flowers delivered due to seasonal variations or availability.
The packaging of the flowers and other products may vary. The packaging of the flowers and other products may differ from those shown in the images on our website.
9. Warranties
All partner florists of localflorist.ch strive to satisfy the customers who trust us. Therefore, we guarantee you that all orders will be handled professionally by competent florists and that the flower arrangements will be delivered personally, in perfect condition, and on time.

- Delivery by the florist of the ordered product category
- Fresh flowers of impeccable quality
- Adherence to delivery deadlines
- Calculation of the price indicated on the day of delivery by the partner florist and on our website
With this guarantee, we want to assure you of the care and professionalism we apply when handling your order. If the delivery or quality of the shipment does not fully satisfy you, please let us know your criticism within a maximum of 3 days after the delivery date via our website or by email.
All orders are processed and executed exclusively by professional florist partners of localflorist.ch.
Of course, all data used to execute your order remains confidential and will not be shared with third parties.
We do not store any credit card numbers on our servers. After each order, the credit cards are charged immediately via an encrypted connection to the credit card companies.
10. Applicable Law and Jurisdiction
Swiss law applies to the relationship between the customer and LesFleurs Daily-flowers Sàrl.
The jurisdiction for natural persons is in Neuchâtel or at the customer's residence.
